In 2010 the New Rules of Court was amended to allow videotaping of IMEs. The idea was to help ensure that the defence IME doctor's questions asked were fair and that the Plaintiff’s answers were accurate. One consequence has been that many Defence IME doctors have refused to do an IME if videotaping is involved or if a Nominee is present. This presentation will look at the changes to the IME Rules and recent judicial decision surrounding IMEs including when a court may disallow videotaping and waiver of privilege of the Plaintiff IME.
